

| Mediation is an alternative form of dispute resolution. Mediators act as neutral facilitators. In this way, mediation differs from litigation and arbitration, where the dispute is decided for the parties by a judge or arbitrator, respectively. In a mediation, the parties meet with the mediator in a joint session to explain their side of the dispute. They meet with the mediator separately to elaborate on their position and any options for resolving the dispute. A private meeting with a party, their lawyer and the mediator is often referred to as a caucus. A cornerstone of the mediation process is confidentiality. Their are two types of confidentiality; external and internal. The parties may not disclose anything that is said in the mediation to anyone else outside of the mediation. The mediator also may not disclose anything that is said privately by the parties in caucus unless he or she is authorized to do so. R.
